Transferring copyright by assignment

A High Court case provides a useful reminder to anyone seeking a transfer of intellectual property rights to obtain a copy of the assignment that has been signed by the assignor. These matters are often overlooked as being mere administrative details, but until this is done, the purported assignee will only have equitable title to the rights.

In this case, the High Court granted an application for a declaration of ownership of copyright in a logo used on the INNOCENT branded range of products, following the grant of a declaration, in favour of the design agency that created the logo, that the Community trade mark registration of it was invalid.
