Streathers litigation department is a boutique and specialist dispute resolution practice within the firm.

Its partners and consultants recognise that in commercial disputes the world keeps spinning once the dispute is over. That there can be a larger long term personal or business objectives for the client. What the partners appreciate is that what clients require is the right commercial advice, as well as the right legal advice, in resolving their issues. That ethos is borne of long experience and expertise in the field of dispute resolution.

Sometimes that entails litigation. In other situations a negotiated or mediated resolution may be preferable. We have deep experience in all these avenues. And a high calibre service is at the heart of our approach – understanding the clients’ needs and objectives, being responsive, and being precise in how we go about it.

Typically specialising in two areas, high value complex commercial dispute resolution, and property related disputes, the department also has considerable experience with contentious probate cases, and offers niche advice in Art law and regulatory work.

Commercial

Acting for the Respondent in A v M [2021] EWFC 89: Whilst essentially a financial remedies action pursuant to a divorce, the case centred on how to treat carried interest entitlements in private equity. Further reading can be found here Financial Remedies Journal.
Acting for the Claimant in Naibu Global International Co PLC v Pinsent Masons [2020] EWHC 2719 (Ch): A case concerning professional negligence against the nominated advisers and the legal firm who acted on the Naibu’s float on 30 March 2012. See further reading here Global Arbitration Review.
Acting for the successful Claimant in Khakshouri v Cash and Jimenez [2017] EWHC 3392 (QB): Obtaining judgment in the Claimant’s his favour for over £3m plus costs after a fiercely defended trial, in a claim for fraudulent misrepresentation arising out of a loan made to Charlton Athletic FC. The Defendants were represented by Herbert Smith Freehills and Quinn Emanuel Urqhuart and Sullivan. Property

Acting for the successful Claimant in the 4-day trial of in Maria Jesus El Massouri v Omani Estates Limited [2024] EWHC 534 (Ch), reported in The Times and The Telegraph, amongst other national newspapers. The case was issued alongside an urgent without notice injunction to prevent break-ins to tenanted property, with the underlying proceedings concerning the new adverse possession regime and estoppel.

Acting for 6 successful Claimants in a 4-day trial of Benton and Others v Paes and Others (2023, County Court at Central London), reported in The Times and The Telegraph, amongst other national newspapers. This case involved declarations on a boundary dispute concerning a 20 x 15ft disputed strip across 3 freehold properties, dismissal of a counterclaim for a prescriptive easement and indemnity costs.

Acting for the successful applicant in Declan Joseph Harkin v. Notting Hill Genesis (Land Registration Property Tribunal REF/2018/0694). The case concerned adverse possession of a commercial yard under the Limitation Act 1980, and the aggregation of periods of possession with the former occupier (M). In this case, M had already established the required 12 years of possession when he retired and gifted the land to the applicant. The Court held that M’s interest was capable of informal assignment to the applicant, and need not comply with any further formalities.
